The Omnibus Directive (Directive (EU) 2018/822) is a European Union directive that amends several existing EU directives related to consumer protection. The directive relates to changes in price information and fictitious discounts used.
Legal Notice:
Directive 98/6/EC of the European Parliament, the Council of February 16, 1998 on consumer protection in the indication of prices of products offered to consumers (OJ L 080, 18.3.1998, p. 27, as amended).
According to Article 6a(1), it reads:
According to Article 6a (1) added by the Omnibus Directive to Directive 98/6/EC, the price before the reduction is applied must be stated in any information about the promotion, price reduction applied. The provision also states that the previous price to be given cannot be the price from a period of less than 30 days applied before the reduction.
If the price is listed on the product card, there must also be a message saying the lowest price of the product in effect a minimum of 30 days before the price change.
If a product or service has been on sale for up to 30 days, it is the ecommerce owner's responsibility to inform the user of the lowest price in effect from the date of its introduction.
When operating an online store, there is an obligation on the owner to prove that the reviews on the store are real reviews from consumers who have purchased the product. The procedure is common among smaller stores that, through fictitious and purchased reviews, inflate the average rating of a product, misleading consumers.
Every online store owner should be able to demonstrate the veracity of reviews from real users. This can be achieved by allowing reviews to be left only for users who have purchased the product.
Negative comments and opinions. Another important issue is the inability to interfere with negative comments and attempt to delete them.
According to the new regulations, the terms and conditions of the online store should be updated with a current phone number, liability provision.
A phone number is becoming a requirement for compliance. It should be prominently displayed on your online store and allow you to be contacted for returns, complaints or questions about availability or delivery. It cannot be a number that is not supported by anyone in your online store.
